DATE: 30th APRIL, 2024 P.C.:- 1] The Petitioners seek to raise a challenge to the declaration as "fraud" under the Circular dated 1st July, 2016. It is submitted that copy of such declaration as "fraud" has not been served on the Petitioners.
2] The learned Counsel appearing on behalf of the 2nd Respondents submits that on three earlier occasions, the Petitioners had sought to challenge the said declaration but the respective proceedings were withdrawn for various reasons with liberty to take appropriate steps. 3] Issue notice to Respondents, returnable on 11th June, 2024. 1/2
