Mr. Rawal mentions Writ Petition No. 2516 of 2024 and states that he has instructions to withdraw this Petition. 2.
Mr. Takke, the learned AGP, appears for the State. 3.
Though the Petition is not on Board, the same is taken on Board.

At the request of the learned Counsel for the Petitioner, we grant the Petitioner leave to withdraw this Petition with liberty to file an Appeal against the order which is impugned in this Petition.

The learned Counsel for the Petitioner states that the Appeal would be filed within four weeks from today. He also points out that this Petition was filed within the limitation period prescribed for instituting an Appeal.

Considering the above factors, we direct that if the Appeal is indeed filed within four weeks from today, the Appellate Authority must consider the Appeal on its own merits and in accordance with law without adverting to the issue of limitation.

All contentions of all parties on merits are kept open. 8.
The Petition is disposed of as withdrawn with liberty in the above terms.
