The learned counsel appearing for the parties jointly submit that parties have amicably resolved the disputes amogst them. A Memorandum of Settlement has been executed on 28 November 2025. The same is placed on record alongwith Affidavit dated 16 December 2025 on behalf of the Petitioner. Alongwith the said Affidavit, copies of Undertakings signed by each of the Respondent-workmen are also appended. In view of settlement of disputes, nothing remains to be adjudicated in the Petition.

Accordingly it is directed that the order dated 24 January 2024 passed by the Industrial Court , Mumbai, in Complaint (ULP) No.398 of 2017 shall stand modified, regularization/permanency and arrears of pay shall be regulated and governed by the Memorandum of Settlement.
