After the petition was heard for some time, Mr. Khambata on instructions stated that petitioner needs to answer only the summons dated 27th March 2024 and need not respond to summons that was issued on 12th January 2024 which is the subject matter of challenge in this petition. 2.

Mr. Kadam states that the documents called for in the annexure to the summons dated 27th March 2024 shall be made available within four weeks from today. If any document is not available, petitioner shall say so and also say whether the documents also available and with whom. Purti Parab

At this stage, Mr. Dwarkadas who is appearing for Respondent No.4 states that Respondent No.4 had also received the summons identical to the summons dated 12th January 2024 and Respondent No.1 should be directed to issue a fresh summons as it has done to petitioner in this case on 27th March 2024. Mr. Khambata responded by saying that Respondent No.4 has already responded/replied to the summons dated 12th January 2024 and furnished information and documents called for. Mr.Khambata states if any further documents or information is required they may issue fresh communication/summons to Respondent No.4. 5.

All contentions are kept open.
