Learned Advocate for the Respondent No.3 points out the judgment of this Court in the case of Jagdish Pitamber Pawar vs. Pitamber Pundalik Pawar dated 29th November 2023 where the High Court has held that there is a remedy of Appeal under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 to those who are affected by the said Orders.

After having considered the Judgment, the learned Advocate for the Petitioner seeks leave to withdraw the Petition with liberty to file an appropriate proceedings before the Appellate Court.

Having considered the submissions of both the sides and the Respondents fairly agree to the stay the effect and implementation of the Order dated 11th January 2024 4.

The Petition is allowed to be withdrawn with no order as to costs.

Effect and implementation of the Order dated 11th January 2024 is stayed for a period of two weeks from the date of uploading of this Order on the website of Bombay High Court.
