Learned counsel for the parties agrees that the main issue raised in this petitioner stands addressed by The Finance (No.2) Act, 2024 whereby Section 140(7) was amended. Accordingly, learned counsel for the parties agree that the impugned order dated 31 October 2023 to be set aside, and the matter remanded to the relevant proper officer for fresh adjudication of the show cause notice dated 20 May 2022 in accordance with law and after taking cognisance of The Finance (No.2) Act, 2024.
