The contention of Mr. Tulzapurkar, learned Senior Advocate representing the petitioners, primarily is that the order passed for rejecting the technical bid of the petitioners does not indicate any reason whatsoever, rather it is absolutely vague and bald.

Learned Additional Government Pleader states that she shall file affidavit taking the preliminary grounds regarding the maintainability of the writ petition and also disclosing the reasons for rejecting the technical bid of the petitioners. On the basis of instructions received from Ms. Diksha Patil, Law Officer of respondent no. 1, she has submitted that commercial bid is not likely to be finalized in 15 days from today.

In the aforesaid circumstances, we direct the learned Additional Government Pleader to file a short affidavit-in-reply by 28 June 2024, to which rejoinder-affidavit, if any, shall be filed by the petitioners by 3rd July 2024.

Stand over to 4 July 2024. To be placed High on Board.

Till next date of the listing, in terms of the statement made by the learned Additional Government Pleader on the basis of instructions received by her, the commercial bid shall not be finalized.
