Stand over to 23 September, 2024, high on board to enable Mr. Khanchandani, learned Counsel for the Respondents to take instructions. We may also clarify it is the case of the petitioner that the refund amounts have been partly received by the petitioner. However, the interest amount has not been received. It is the petitioner's contention that it is a statutory obligation of the Respondents to pay interest amount.

Before we hear the parties on the merits and the rival contentions, it will be open to the Assessing Officer to look into these issues and if any amounts as the law would mandate is yet to be refunded to the petitioner, which obviously would also include the interest amount, then an appropriate position in that regard be taken. 3.
Accordingly list these proceedings on 23 September, 2024, high on board. Reply affidavit, if any, to be placed on record well in advance and also a copy of the same be furnished on the Advocates for the petitioner.
