The learned Advocate appearing on behalf of the Petitioner states that after the filing of this Writ Petition, he had also filed an Appeal against the Assessment Order before the CIT Appeals. The CIT Appeals also ruled against the Petitioner and the Petitioner is now before the ITAT. 2.

In these circumstances, the learned Advocate for the Petitioner stated that he had instructions to withdraw the above Writ Petition. Considering the aforesaid statement, the above Writ Petition is dismissed as withdrawn. No order as to costs.
