Heard learned counsel for the parties.

By adopting the reasoning in our order dated 10 November 2025 disposing of Writ Petition No.3383 of 2025 we decline to admit this Petition to relegate the Petitioner to avail of the alternate remedy of Appeal against the impugned order in original dated 8 March 2024.

Learned counsel for the Petitioner states that such Appeal would be filed within four weeks of the uploading of this order. If this is done, we direct the appellate authority to decide the Appeal

13-WP-3780-2025.DOCX on merits without adverting to the issue of limitation. This is because the Petitioner was bona fide pursuing this Petition. Incidentally, our above referred order also relates to the very same order in original which was being challenged by M/s. Gupta Metal Sheeta Pvt. Ltd., who were co-noticees. Therefore, following the principle of consistency, we have relegated even this Petitioner to avail of the alternate remedy of Appeal.

All contentions of all parties, including the contention raised by the Petitioner in this Petition, are expressly left open to be considered by the appellate authority in the first instance. 5.

This Petition is disposed of with liberties in the above terms. No costs. All concerned to act upon an authenticated copy of this order. (Advait M. Sethna, J) (M. S. Sonak, J.)
