The challenge in this petition is to the levy of property tax. No representation has been made to the Municipal Corporation, as also an alternate remedy is available to the petitioner under the provisions of the Mumbai Municipal Corporation Act, 1888 by approaching the Small Causes Court. 2.

In this view of the matter, we are not inclined to entertain this Writ Petition, as the petitioner has an appropriate statutory remedy which is required to be espoused by the petitioner as the law mandates. 3.

Thus, keeping open all contentions of the parties, the petition stands disposed of, with liberty to the petitioner to take recourse to appropriate remedy as may be available in law.

Disposed of. No costs.
