After arguing at some length, learned counsel for the petitioner prays that the petitioner may be permitted to withdraw the writ petition with the liberty to file a fresh petition.

The petitioner relies upon a draft notification issued by the Maharashtra Pollution Control Board inviting suggestions and objections from public and the very basis of the petition is the said draft notification, however, the final notification has not been enclosed with the writ petition.

In the aforesaid view, the petition is dismissed as withdrawn with the liberty as prayed for.

If the petitioner files any fresh petition, it should be based on appropriate pleadings.
