Heard learned AGP for the Respondent-State. It is submitted by learned AGP that there are disputes between the two groups of the concerned educational institution, as since the issue is pending before the Charity Commissioner, the Education Officer has simply placed the proposal for approval on hold. 3.

Merely because there is a dispute within two groups of rival factions of the Management should not be a factor to

Bhogale 30.wp-4100-2024.odt dissuade the Education Officer from deciding the proposal on its own merits. Accordingly, the Education Officer is directed to decide the proposal of the Petitioner on its own merits within a period of ten weeks from the date of communication of this order. If there are deficiencies in the proposal, the Petitioner as well as the Management be given an opportunity to rectify the deficiencies.

All contentions are kept open.

The Writ Petition is disposed of.
