The impugned notice dated 3rd January 2024 issued by the Municipal Corporation which was a 15 days notice calling upon the Petitioner to vacate the premises.

The learned Counsel for the Petitioner has fairly pointed out that the notice period has already expired, being more than 23 months at this stage, and that no fresh notice has been issued thereafter. Accordingly, the said notice has become infructuous.

In the event any fresh notice is issued either by the BMCC or by the SRA to the Petitioner, the procedure known to law shall be undertaken for seeking eviction of the Petitioner. Further, if the Petitioner is entitled to any Permanent Alternate Accommodation (PAA), such claim shall be duly considered, and appropriate orders shall be passed, including after considering any reply filed by the Petitioner to such notice.

All contentions of the parties in this regard are expressly kept open. 5.
