Learned counsel for the Petitioner, on instructions, seeks leave to withdraw this Petition with liberty to challenge the impugned communication before the Hon'ble Gujarat High Court. This is because the impugned communication was issued by the 5th Respondent having office in Gujarat. One of the officials from the State of Maharashtra have not even been impleaded in this Petition.

Accordingly, we grant leave with liberty as prayed for. This Petition is disposed of as withdrawn with liberty to the Petitioner to institute appropriate proceedings in Gujarat. 4.

All contentions of all parties are left open. 5.

At this stage, we record that even the learned counsel for the Respondents had raised a preliminary objection by submitting that this Petition should have been instituted in Gujarat.

The Petition is disposed of with liberty as prayed for. There shall be no order as to costs.

All concerned to act on an authenticated copy of this order.
