Mr. Sanghavi, learned counsel for the Petitioner, based on instructions, seeks leave to withdraw this Petition with liberty to Appeal the Impugned Order. Mr. Sanghavi states that such Appeal may be filed within six weeks from the date of uploading of this order. He submits that this Petition was instituted within the period of limitation prescribed for instituting an Appeal. Therefore, the period during which this Petition was pending may kindly be excluded for computing the limitation period. 2.
If an Appeal is indeed instituted within six weeks after complying with the usual formalities like pre-deposit etc. then, we

All contentions of all parties, including the Petitioner's contention raised in this Petition are expressly kept open to be decided by the appellate authority in the first instance. This Petition is disposed of as withdrawn with liberty in the above terms. No costs. 4.
