The limited grievance of the petitioner is that Annexure II is not being finalized. The slum scheme in question would have about 285 slum dwellers. The action in regard to finalize Annexure II commenced sometime in July 2024. It appears to be not in dispute that the eligibility of 120 slum dwellers has already been determined; however, further action has been stopped since 28 August 2024.

It is the petitioner's contention that the said work was abruptly stopped at the behest of local MLA. What has been contended by the petitioner is that the Slum Rehabilitation Authority ("SRA") cannot act at the behest of the local MLA, as the SRA is required to act in accordance with law and as per the provisions of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 read with the Rules.

We find substance in the contention as urged on behalf of the petitioner. Accordingly, we direct the SRA to place on record an affidavit as to why abruptly the action in regard to finalizing Annexure II was stopped, including to set out the correct reasons and the name of the officer who decided to stop taking further action for any such reason. In the event the name of the officer and the responsibility of such officer who was discharging such duty are not set out in the affidavit, we will be constrained to hold that it was the Chief Executive Officer of the SRA was responsible for stopping action to finalize Annexure II. Let such affidavit be placed on record on or before 01 December 2025. A copy of the same be also served on the same day, on the advocate for the petitioner. 4.
We shall hear the parties accordingly on the present proceedings on the adjourned date of hearing.
