This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Anil Sobers Francis being sole Executor named under the Will of deceased. The deceased namely Leela A. Allen died at Kerla on 26.08.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 30.5.2015. The said Will is in English language. The Para No. 2 (last line) of the Will refers to the appointment of Executor. Only One Executor appointed under the Will.

3. Ld. Advocate for petitioner submits that deceased died widow and issueless. Petitioner is the son of sister of the deceased. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Prakash P. Pednekar dated 23.08.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 27.1.2025 is filed. 5.

However, the Class II legal heirs of deceased are not mentioned in the petition. Advocate to take steps accordingly. Learned advocate seeks leave to amend the para No. 7 of the Petition. Leave granted. Ld. Advocate for petitioner to carry out amendment within twelve weeks from the date of uploading of this order. Ld. Advocate for petitioner re-upload amended petition on the official portal of the Bombay High Court.
