TP/244/2025 (E-filing) Mr. Anand Tiwari, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Natasha Sanjeev Kapoor and Mikhail Surender Shahani being Executors named under the Will of deceased. The deceased namely Misha Ashok Mirchandani died at Mumbai on 31.03.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 12.04.2023. The said Will is in English language. The Page No. 2 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that deceased was divorcee and she was married twice. First husband of deceased was divorced and decree of divorced dated 12.05.1992 is annexed to the petition as Exhibit - "E". Deceased has one son and one daughter from her first marriage who are petitioners herein. Deceased was remarried to Ashok Hiro Mirchandani and he was divorced by decree of Family Court dated 19.12.2005. Copy of the said divorce decree is annexed to the petition as Exhibit - "F". Deceased had no issue from the second marriage. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Mohammed Kutubuddin Bhol dated 09.10.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 12.02.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
