TP/320/2025 (E-filing) Ms. Komal Shah i/b. Yogini Gada, Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Vinita Mohinesh Advani being sole surviving Executor named under the Will of deceased. The deceased namely Gulab Tolaram Lalwani died at Mumbai on 13.05.2016. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 19.10.2024. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only one Executors appointed under the Will. Petitioner is sole surviving executor and another executor namely Kavita Gulab Lalwani died on 19.05.2024. Copy of her death certificate is annexed to the petition as Exhibit - "D".

3. Ld. Advocate for petitioner submits that mother and wife of deceased predeceased the deceased. Deceased was survived by two married daughters. Out of them one daughter is petitioner herein and another daughter has given her consent in favour of the petitioner. Consent Affidavit on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Mohinesh Advani dated 16.11.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 07.03.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
