TP/331/2025 (E-filing) Mr. D. R. Mishra, Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Anuradha Salil Shah being one of the Executrix named under the Will of deceased. The deceased namely Veena Mayank Parikh died at Kolkatta on 16.09.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 05.05.2022. The said Will is in English language. The Para No. 1 of the Will refers to the appointment of Executor. Only three Executors appointed under the Will. Petitioner is one of the executors and remaining two executors namely Anand Laxminarayan Parihar and Rupande Namit Shah have reserved their rights as an Executors and Affidavit of Reserving their rights dated 03.12.2024 and 22.11.2024 are filed to that effect respectively.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. One daughter of deceased namely Mandakini Parihar died leaving behind two sons. Deceased was survived by two daughters and two grandsons. Out of them one daughter is petitioner herein and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Vibha Mrudulesh Photographer and Nilesh M. Suchde dated 02.12.2024 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 15.02.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
