TP/334/2025 (E-filing) Mr. Amogh Patkar a/w. Akshata Deshpande i/b. Trigoon Sharad Patwardhan, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Avinash Malhari Kulkarni being sole Executor named under the Will of deceased. Deceased namely Vidya Vinayak Mulay said to have died at Mumbai on 23.06.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind her last Will and Testament which was duly executed at Mumbai on 29.12.2023. The said Will is in English language.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Deceased died issue-less. Parents of husband of deceased predeceased the deceased. Husband of deceased died on 13.05.2021. Deceased had one sister namely Sudgha Raghunath Idate predeceased the deceased, who died on 01.04.2000 leaving behind her husband and two sons. Husband of deceased had one sister namely Asha Malhari Kulkarni who predeceased the deceased, died on 17.11.2020 leaving behind two sons and one daughter. Thus, Deceased was survived by one brother-in-law, four nephews and one niece. Out of them one nephew is petitioner herein and all other legal heirs have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavits of Dattatray Shankar Sathe and Kavita Ganesh Pawar both dated 23.10.2024 both the Attesting Witnesses to the Will are filed. Affidavit of Service of General Citation dated 04.03.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
