TP/346/2025 (E-filing) Ms. Preksha Shah i/b. Univesal Legal, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Maria Alcide Coelho being sole Executrix named under the Will of deceased. The deceased namely Clara Hyacinth Coelho died at Mumbai on 21.04.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 29.07.2021. The said Will is in English language. The Para No. 12 of the Will refers to the appointment of Executrix. Only one Executrix appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. One daughter of deceased namely Celcia died leaving behind her husband and her issues not mentioned. Deceased was survived by husband, one son and one son-in-law who all have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Renita Fernandes dated 23.10.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 25.03.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is completely ready for final grant.
