This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Mohammed Arif Ansari being sole Executor named under the Will of deceased. The deceased namely Rehana Mehboob Khan died at Mumbai on 07.10.2017. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 06.10.2017. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein. The properties mentioned in the schedule reflected in the Will.

3. Ld. Advocate for petitioner submits that deceased died as spinster. Father and grand parents of deceased predeceased the deceased. Deceased was survived by mother and two brothers. Out of them the mother and one brother have given their consents in favour of the petitioner. Consent Affidavits are on record. Another brother namely Mohammed Aziz Mehboob Khan has been served through newspaper publication and Affidavit of Service of Publication dated 12.07.2025 is filed to that effect as directed in the CHOL No. 190 of 2025. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Kaif Aziz Khan dated 21.10.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 21.02.2025 is filed. Administration Bond is not filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is completely ready for final grant.
