TP/428/2025 (E-filing) Mr. Sushil Inamdar i/b. A. B. Shrikhande, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Darius Dinshaw Pandole and Farokh Dinshaw Pandole being sons and surviving Executors named under the Will of deceased. Deceased namely Kamal Dinshaw Pandole alias Kamal D. Pandole said to have died at Mumbai on 23.10.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind her last Will and Testament which was duly executed at Mumbai on 03.02.2020. The said Will is in English language. Petitioners had appointed his three sons as an Executors named under the Will of deceased and one son (Executor) namely Jehangir Dinshaw Pandole died on 04.09.2022. Copy of death certificate is annexed to the petition as Exhibit "C".

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. One son of deceased namely Jehangir Dinshaw Pandole died on 04.09.2022 as a bachelor. The Deceased was survived by two sons who both are petitioners herein. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Hormazdiyaar S. R. Vakil dated 05.12.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 25.02.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
