TP/464/2025 (E-filing) Mr. Siddharth Desai i/b. Ankita D. Gala, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Vijay Pannalal Narula being sole Executor named under the Will of deceased. The deceased namely Pannalal Harnamdas Narula died at Mumbai on 08.06.2021. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 26.02.2015. The said Will is in English language. The Page No. 3 of the Will refers to the appointment of Executor. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. One son of deceased namely Ajay Narula died on 01.12.2008 leaving behind his widow and two daughters. One daughter of deceased namely Neelima died on 19.01.2014 leaving behind one daughter and one son. Deceased was survived by one son, one daughter-in-law, three granddaughters and one grandson. Out of them son is petitioner herein and the daughter-in-law had filed Caveat (L) No. 3338 of 2025 and the same is rejected under Rule 986 of the Bombay High Court (Original Side) Rules, 1980 by an order dated 09.04.2025. Rest of all the legal heirs have been served with the citation through the office of Sheriff of Mumbai and Affidavit of Service dated 18.07.2025. All of them have been served in the month of February, 2025. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of S. S. Baheti dated 14.11.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 19.07.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
