Ld. Advocate for the petitioner, by this praecipe, dated 04.11.2025, requested to correct the order so as to issue the Letters of Administration (De-Bonis-Non). 2.

Perused the order dated 19.09.2025, passed by undersigned officer. As per the said Order, the department is directed to issue letters of administration to the petitioner. However, vide the Testamentary Petition, having TP No. 298/2021, the Grant was issued to Sunita Kishinchand Alimchandani, a daughter of the deceased. However, she died as spinster, without administrating property, mentioned in the scheduled-I of this petition. Present petitioner, being son of since deceased daughter of the deceased's name was mentioned as one of the surviving legal heirs of the deceased. Hence, vide Sec. 259 of the Indian Succession Act, 1925, the original grant might have been issued to present petitioner and therefore, Letters of Administration (De-Bonis-Non) is required to be granted to the petitioner. Hence, following order, 3.

In the paragraph No.1, 7 as well as in the order clause No.1 of the order, after words "...Letters of administration" words "(De-Bonis-Non)" shall be added. The corrected copy of the order to be uploaded in the CIS.
