TP/561/2025 (E-filing) Mr. Melvin Francis i/b. Hardik Sharma, Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Pankaj Shamji Sangoi being sole Executor named under the Will of deceased. The deceased namely Rasila Kirti Kothari died at Thane on 09.12.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Thane on 20.11.2022. The said Will is in Gujarati language and translation is annexed to the petition. Affidavit of Advocate for petitioner for translation of the Will is not annexed to the petition. Only one Executor appointed under the Will who is petitioner herein.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by husband and two sons. Out of them two sons have given their consents in favour of the petitioner. Consent Affidavits are on record. Consent Affidavit of husband of deceased is not filed. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Dr. Sneha Kothari dated 30.11.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 21.02.2025 is filed.

5. Ld. Advocate for petitioner file praecipe to place on board as and when the matter is ready for final grant. Hence, remove from board. 09.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
