13. TP/591/2025 WITH WILL/237/2025 Shri Hussain Dholkawala, Advocate for Petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Shernavaz Neville Ratnagar being the Executor named under the Will of deceased. The deceased namely late Smt Hufriz Nani Chession, died at Mumbai on 21.05.2020. Copy of death certificate is annexed to the petition. Copy of AADHAR Card is annexed for the identification purpose.

2. The deceased left behind him last Will and Testament which was duly executed at Mumbai on 11.06.2014. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of two Executors are appointed. One is Petitioner herein and another Executor Khushroo Driver has filed the affidavit dated 18.12.2024 reserving his rights as an Executor.

3. As per para 9 of the Petition the parents and husband of the deceased predeceased the deceased and deceased is survive by one son who has given his consent in favour of the Petitioner herein.

4. The affidavit of attesting witness Mr. Rati Bahadur Amrolia, it is dated 18.12.2024. The affidavit of general citation is filed and it is dated 25.02.2025.
