TP/616/2025 (E-filing) Ms. Ankita Gala, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Radha Ronak Thakker being sole Executrix named under the Will of deceased. Deceased namely Radha Anathakrishnan alias Radha Anatha Krishnan alias Radha Ananthakrishnan said to have died at Mumbai on 02.12.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Pan Card is annexed to the petition.

2. Ld. Advocate for petitioner submits that deceased left behind her last Will and Testament which was duly executed at Mumbai on 27.08.2022 and the same was registered on 29.08.2022 with the office of Sub-Registrar, Assurances at Kurla. The said Will is in English language.

3. Ld. Advocate for petitioner submits that parents and husband of deceased predeceased the deceased. Parents of husband of deceased predeceased the deceased. Deceased had two sons and one married daughter. One son of deceased namely C. A. Mahadevan died on 11.04.2018 leaving behind one daughter. Another son of deceased namely Gopal Anant Krishnan died on 18.10.2020 leaving behind one daughter. Daughter of deceased died on 09.01.2016 leaving behind one adopted son. Deceased was survived by two married granddaughters and one minor adopted grandson. Out of them one married granddaughter is petitioner herein and the another married granddaughter has given her consent in favour of the petitioner. Consent Affidavit for minor grandson of deceased filed through his father and natural guardian dated 21.12.2024. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner has produced the order of the District Court, Jalana passed under section 9 of the Guardians and Wards Hindu Adoption and Maintenance Act as proof of adoption of the minor adopted grandson. The same is uploaded through e-filing separately. .......2

5. Petitioner's oath is filed. Affidavit of Usha Hitesh Jani dated 21.12.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 11.02.2025 is filed. All other legal formalities are complied with. All other legal formalities are complied with. Hence, petition is granted.

6. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
