TP/679/2025 (E-filing) WITH WILL/271/2025 Mr. Vinay Shingada, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament alongwith Codicil of deceased filed by petitioner namely Kanan Rupesh Shah being sole Executrix named under the Will of deceased. The deceased namely Saroj Dinkarrai Vasa died at Mumbai on 01.07.2024. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Thane on 06.06.2018 and Codicil was duly executed at Vashi, Navi Mumbai on 01.10.2018. The said Will and Codicil are in English language. The Para No. 2 of the Will refers to the appointment of Executrix. Only one Executrix appointed under the Will who is petitioner herein. The properties mentioned in the Schedule I annexed to the petition is referred in para No. 6 of the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Husband of deceased since deceased the deceased who died on 19.07.2024. Deceased was survived by one son and one daughter. Out of them daughter is petitioner herein and son has been served the citation through newspaper publication and Affidavit of Service of publication dated 18.07.2025 is filed to that effect as per order dated 06.05.2025 passed in Chamber Order No. 187 of 2025. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Mahendra Dayalal Shah dated 15.11.2024 one of the Attesting Witnesses to the Will is filed. Affidavit of Chhaya Bhera nee Chhaya Divecha dated 15.11.2024 one of the Attesting Witnesses to the Codicil is filed. Affidavit of Service of General Citation dated 31.10.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
