Administration bond is defective as surety is one of the legal heirs of the deceased.

Furthermore, petition number and dates mentioned in the administration bond are incorrect. Hence, petitioner to execute the administration bond as per form no. 118 r/w Rule 420 of the Bombay High Court (O. S.) Rules, 1980.

Later on, Ld. Advocate for the Petitioner moved a praecipe dated 04.04.2025 and thereby seeks permission to amend the petition by making an averment about the grand parents of the deceased. Submission is accepted. Praecipe is allowed. Upon filing of the additional affidavit of the petitioner confirming the amendment, re-verification is dispensed with OR petition can be re-verified online/CIS Portal, as the case may be.

Petitioner to carryout an amendment within three weeks from the date of uploading of this order, if petition is pending.
