This petition is for Succession Certificate in respect of certain debts belonging to deceased filed by petitioners namely Sunil Mahendra Dagli and Phalguni Hardik Shah both being son and married daughter of deceased respectively. Deceased namely Chandrika Mahendra Dagli died intestate at Mumbai on 02.05.2021. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is already annexed to the petition.
2. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Deceased was survived by one son and one daughter who are petitioners herein. There are no other legal heirs.
3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 16.05.2025 is filed. As all surviving legal heirs of the deceased are petitioners before this Court and the right or interest of no other legal heir is required to be protected. Hence, Administration Bond is dispensed with. Delay is explained and same is condoned. All other legal formalities are complied with. Hence, petition is granted.
