Not on board. Mentioned by way of praecipe, as the department is not accepting the administration bond furnished on behalf of the petitioner, on the ground that the surety is residing outside the jurisdiction of this Court.

In a similar situation, in the case of Prakash Dularam Punjabi & Ors. (Testamentary Petition No.19 of 2024), this Court directed that such an administration bond be accepted by the department. In the said order, reliance was placed on an earlier order dated 1st December 2021, passed by this Court in Testamentary Petition No. 166 of 2020 (Ashok Chanderbhan Choithani).

In view of the above, the department is directed to accept the administration bond in the present case, furnished on behalf of the petitioner.
