17. TP/720/2024 Mr. Uttam Rane, Advocate for Petitioner P. C. : 1. Perused Petition. Heard Ld. Advocate for petitioner. Ld. Advocate for petitioner submits that citation is duly served upon the legal heirs mentioned at Sr. Nos. 2(a) to 2(c) however, they did not appear and therefore, the Hon'ble Court is directed the office to proceed with the petition in accordance with law.
2. Ld. Advocate for petitioner submits that these non-consenting legal heirs were parties to the Partition Suit before the City Civil Court in Suit No. 2573 of 2019, which has been disposed of in terms of Consent Terms. Vide order dated 20.04.2023, passed by the City Civil Court, Mumbai these non-consenting legal heirs are received their 1/3rd shares. Therefore, requisition to justify their shares does not arise. However this requisition has not been dispensed with by an order of the Hon'ble Court, which was raised vide an order dated 16.03.2024.

Ld. Advocate for the petitioner submits that it was not prayer before the Hon'ble Court and therefore there is no order in this regard. Hence, He will take the steps, accordingly.
