TP/825/2025 (E-filing) Mr. M. S. Bhandari i/b. Pranjali Bhandari, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Mandakini Prabhakar Edekar being one of the Executors named under the Will of deceased. The deceased namely Satish Prabhakar Edekar died at Mumbai on 04.07.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 23.07.2021. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executor. Only two Executors appointed under the Will. Petitioner is one of the executors and another executor namely Anil Ramesh Edekar has forwarded e-mail dated 26.08.2023 stating that he is holding his rights as an Executor and he will exercise his rights as and when required. However, this statement is required to be made on Affidavit. Advocate for petitioner take steps accordingly.

3. Ld. Advocate for petitioner submits that deceased died as bachelor. Deceased was survived by one sister only who is petitioner herein. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Shreyas M. Munim dated 10.11.2023 one of the Attesting Witness to the Will is filed.

5. However, Affidavit of Service of General Citation is not filed. Advocate to take steps accordingly.
