TP/833/2025 (E-filing) Mr. Anthony Fernandes i/b. Adke Abhishek Ashok, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament alongwith Codicil of deceased filed by petitioners namely Varsha K Shah, Amit K. Shah and Vaishali Saraiya being Executors named under the Will of deceased. The deceased namely Kumar Chimanlal Shah died at Mumbai on 07.06.2017. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will alongwith Codicil and Testament which was duly executed at Mumbai on 03.03.2011 and Codicil was duly executed at Mumbai on 28.03.2017. The said Will and Codicil are in English language. The Para No. 3 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will.

3. Ld. Advocate for petitioner submits that parents of deceased predeceased the deceased. Deceased was survived by widow, one son and one daughter who all are petitioners herein. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Bharat B. Talati dated 08.05.2024 one of the Attesting Witness to the Will is filed. Affidavit of Pawan Chullani dated 08.05.2024 one of the Attesting Witness to the Codicil is filed. Affidavit of Service of General Citation dated 19.07.2025 is filed separately through e-filing. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
