This petition is for Succession Certificate in respect of certain securities jointly held by the deceased Nos. 1 & 2 filed by petitioner namely Kirit Jagjivandas Shandilya being son of both the deceased. Deceased No. 1 namely Lily Jagjivandas Shandilya died intestate at Mumbai on 23.12.1990. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 27.11.2024 for dispensation of Identification proof of deceased No. 1. The said Affidavit is accepted.
Deceased No. 2 namely Jagjivandas Chhotalal Shandilya died intestate at Mumbai on 20.09.2000. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Passport is already annexed to the petition.
2. Ld. Advocate for petitioner submits that deceased Nos. 1 and 2 are husband and wife. Both the deceased were survived by one son and had no daughter. Son is petitioner herein. There are no other legal heirs. Schedule I annexed to the petition states that the same is jointly held by deceased Nos. 1 and 2.
3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 17.03.2025 and Administration Bond is not required as the petitioner is sole surviving legal heir. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.
