TP/879/2025 (E-filing) Ms. Vrinda Daga a/w. Khushi Jangid, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Certified copy of Will and Testament of deceased filed by petitioners namely Girdharlal Sunderlal Daga, Ashok Kumar Damani and Mahesh Kumar Damani being Executors named under the Will of deceased. The deceased namely Chand Devi Damani died at Delhi on 14.12.2012. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copies of Election Card and Pan Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at New Delhi on 31.10.2012. The said Will is in English language. The Para No. 1.2 of the Will refers to the appointment of Executors. Only three Executors appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that husband of deceased predeceased the deceased. Daughter of deceased namely Sarita died leaving behind her husband and two daughters. Deceased was survived by two sons, one daughter, two granddaughters who all have given their consents in favour of the petitioner. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Savita Damani dated 03.10.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 08.05.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.
