TP/885/2025 (E-filing) Ms. Purva Tambe i/b. IC Legal, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Vinola Anil Parekh and Amit Linesh Sheth being Executors named under the Will of deceased. The deceased namely Ramesh Mansukhlal Mehta died at Mumbai on 12.12.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 27.03.2014. The said Will is in English language. The Para No. 6 of the Will refers to the appointment of Executors. Only four Executors appointed under the Will. Para No. 5 of the petition states that remaining executor nameldy Padma Mehta died on 27.03.2024 and Linesh D. Sheth died on 12.04.2012 and copies of death certificate are annexed to the petition as Exhibits "E" and "F" and other two executors are petitioners herein.

3. Ld. Advocate for petitioner submits that mother of deceased predeceased the deceased. Son of deceased namely Smitin Mehta died on 17.07.2012 leaving behind his widow and two daughters. Deceased was survived by daughter-in-law and two granddaughters who all have given their consents in favour of the petitioners. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Anish Sheth dated 17.10.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 21.03.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed. 25.07.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
