14. TP/925/2025 WITH WILL/370/2025 Shri Ketan Joshi, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Jaideep Nilkanth Mahajan being the Executor named under the Will of deceased. The deceased namely late Shri Nilkanth Girdhar Mahajan, died at USA on 04.04.2023. Copy of death certificate is annexed to the petition. Copy of AADHAR Card is annexed for the identification purpose.

2. The deceased left behind him last Will and Testament which was duly executed at USA, Consolate, Atlanta 4n 31.08.2022. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of two Executors are appointed. One is Petitioner herein and another Executor Ashish Trivedi has reserved his rights as an Executor by an affidavit dated 26.04.2025.

3. As per para 8 of the Petition the parents of the deceased predeceased the deceased and deceased is survive by widow, one son and two daughters. Out of them the son is Petitioner herein and the widow and two daughters have given their consents in favour of the Petitioner herein.

4. The affidavit of attesting witness Mr. Pruthvi Panchal, it is dated 21.01.2025. The affidavit of general citation is filed and it is dated 04.04.2025.
