Heard Ld. Advocate for petitioner. As per Will, there are three executors appointed by the deceased to execute his Will namely Kishore Keshavlal Doshi, Jaisuklal Mohanlal Desai and Jitendra Keshavlal Doshi. Ld. Advocate for petitioner submits that two executors namely Kishore Keshavlal Doshi and Jaisukhlal Mohanlal Desai died and remaining executor namely Jitendra Keshavlal Doshi, has not come forward to apply for Probate.

Ld. Advocate for petitioner to explain how this petition is maintainable for Letters of Administration with Will when there are executors are appointed under the Will.
