TP/1025/2025 (E-filing) Ms. Laleh Pandole i/b. Vashi and Vashi, Advocate for petitioners PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Minali Vijay Lulla and Chetan Hinduja being Executors named under the Will of deceased. The deceased namely Suli Ramchand Sachdev died at Mumbai on 20.04.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 02.10.2019. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that deceased died as spinster. Deceased had one brother and three sisters. One brother and two sisters predeceased the deceased. As per para No. 11 of the petition, deceased was survived by one sister, one nephew and five nieces. Out of them one nephew and one niece are petitioners herein and sister has given her consent in favour of the petitioner. Consent Affidavit is on record. Other four nieces have been served with the citation through the office of Sheriff, Mumbai and Affidavit dated 05.05.2025 is filed to that effect. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Anil Asudani dated 15.04.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 05.05.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
