Ld. Advocate for Sonali Lokhandwala submitted that properties mentioned in the Will are not mentioned in the schedule-i of the Petition and similarly, the properties mentioned in the petition are not mentioned in the Will. Hence, petitioner may be called upon to mention the properties as per the Will. 2.
Ld. Advocate for the petitioner submitted that already the matter was heard by the Hon'ble Court and application has been rejected. 3.
Already the order has been passed by the Hon'ble Court. Hence, unless there is contest, this authority has no reasons to consider the submission of the Ld. Advocate Sonali Lokhandwala. Furthermore, if the department will scrutinize the issue at the time of passing an order as to inclusion or exclusion of the properties, if any. apart from this, the said Sonali Lokhandwala is the legatee under the Will and therefore she may take appropriate proceeding to ensure that administration of the properties will be taken place, according to law.

Ld. Advocate for the petitioner has moved a praecipe dated 17.10.2025 for allowing him to deposit the amount in tune of Rs.3,05,00,000/- vide D.D. No. 106763 towards the legacy given to the non-consenting legatees under the joint Will. In view of Rule 422 of the the Bombay High Court (OS) Rules, 1980, praecipe stands allowed. The petitioner to give the List of the legatees and amount of the legacy payable to them, as per the Will to the department so that amount will be invested accordingly. Furthermore, the said list to be uploaded in the CIS as a compliance. 5.
Upon proof of deposition of the amount, as said above, the requisition raised vide Rule 422 of the the Bombay High Court (OS) Rules, 1980, stands dispensed with. 6.
