This petition is for Succession Certificate in respect of certain debts and securities belonging to deceased filed by petitioner namely Percy Minoo Daruwala and Iqbal Salehbhai Kapasi being son and son-in-law of deceased. Deceased namely Minoo Dhunjishaw Daruwala died intestate at Mumbai on 17.01.1996. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Driving License is already annexed to the petition.
2. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Daughter of deceased namely Ruby Iqbal Kapasi died leaving behind her husband who is petitioner No. 2 herein. Deceased was survived by one son who is petitioner No. 1 herein. There are no other legal heirs.
3. Petitioner's oath is filed. Affidavit of Service of affixation of General Notice dated 07.04.2025 is filed. Since, petitioners are only surviving legal heirs hence, Administration Bond is not required to be filed. Delay is explained and the same is condoned. All other legal formalities are complied with. Hence, petition is granted.
