TP/1178/2024 (E-filing) Ms. Aishwarya Tambe, Advocate for petitioner PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely Suhas Ganesh Bedekar being sole Executor named under the Will of deceased. The deceased namely Malati Ganesh Bedekar died at Mumbai on 20.04.2017. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind her last Will and Testament which was duly executed at Mumbai on 23.11.2005. The said Will is in handwritten Marathi language and translation of the same is annexed to the petition. The Para No.3 of the Will refers to the implied appointment of Executor. Only one Executor appointed under the Will.

3. Ld. Advocate for petitioner submits that husband of deceased died on 10.08.2004. Deceased was survived by two sons and one married daughter. Out of them one son is petitioner herein and married daughter has given her consent in favour of the petitioner. Another son has been served citation by substituted service and Affidavit of Service dated 30.07.2024 is filed that effect. Consent Affidavits are on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Vishwas Shankar Gadre dated 30.10.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 30.07.2024 is filed.

5. However, certifying the translation as true translation is not file. Ld. Advocate for petitioner file praecipe to place on board as ad when all compliance is done in this matter. Remove from board. 25.04.2025 COMPANY REGISTRAR / TESTAMENTARY REGISTRAR
