1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Viral Maganlal Patel and Uday Balkrishna Shetty being Executors named under the Will of deceased. The deceased namely Dr. Chandrakant Ganpatrao Patil died at Mumbai on 23.07.2023. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 21.04.2021. The said Will is in English language. The Para No. 3 of the Will refers to the appointment of Executors. Only two Executors appointed under the Will who are petitioners herein. The properties mentioned in Schedule I annexed to the petition are referred in the Will.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. Deceased had two sons and one married daughter. One son of deceased namely Sanjay predeceased the deceased, leaving behind his widow and one son. Deceased was survived by one son, one daughter, one daughter-in-law and one grandson. Out of them son has given his consent in favour of the petitioner herein. Consent Affidavit is on record. Consent Affidavits of Madhavi (daughter), Sandhya (daughter-in-law) and Suresh (grandson) are not filed hence, Advocate to take steps accordingly. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Uday Balkrishna Shetty dated 01.10.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 21.07.2025 is filed. Delay is explained and the same is condoned.

5. Liberty to move for listing the matter on compliance of requisition stated in Bold hereinabove.
