TP/1221/2025 (E-filing) WITH WILL/501/2025 Mr. Sudir Yadav i/b. Adv. Surin Usgaonkar, Advocate for petitioner. PC : 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioner namely William G. Rodrigues being sole Executor named under the Will of deceased. The deceased namely Hilda Jacinto Rodrigues said to have died at Mumbai on 15.10.2022. Copy of death certificate is annexed to the petition. Identification proof of deceased viz. copy of Aadhaar Card is annexed to the petition.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 21.04.1997. The said Will is in English language. The Para No. 11 of the Will refers to the appointment of two Executor. Petitioner is one of the Executors and another Executor Douglas Delima died accordingly, petitioner has filed Affidavit dated 22.12.2025 stating that the said executor died on 03.12.2018. The same is accepted. The properties mentioned in the Schedule I annexed to the petition is referred in para Nos. 5 and 9 of the Will.

3. Ld. Advocate for petitioner submits that Parents and husband of the deceased predeceased the deceased. Deceased was survived by two sons and one daughter. One son is petitioner herein and another son and daughter has given their consent in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Mila grina Pereira on of the dated 24.12.2023 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 09.04.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
