TP/1232/2025 (E-filing) Mr. D. R. Mishra i/b. M S Bodhanwalla and Co., Advocate for petitioner P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Promodh Malhotra and Rajesh Malhotra being Executors named under the Will of deceased. The deceased namely Premchand Amirchand Malhotra died at Mumbai on 08.12.1992. Copy of death certificate is annexed to the petition. Petitioner has filed Affidavit dated 19.04.2024 for dispenation of identification proof of deceased. The same is accepted.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 11.02.1991. The said Will is in English language. The Para No.1 of the Will refers to the appointment of Executor. Only two Executors appointed under the Will who are petitioners herein.

3. Ld. Advocate for petitioner submits that parents and wife of deceased predeceased the deceased. One son of deceased namely Jagdish died on 19.11.1995. Deceased had no son and was survived by two sons who are petitioners herein. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Kishor M. Vussonji dated 03.05.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 15.04.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed.
