TP/1253/2025 WITH WILL/510/2025 (E-filing) Mr. Sapna Sharma i/b. M/s. K. Ashar and Co., Advocates for petitioner. P.C.: 1. Perused Petition. Heard Ld. Advocate for petitioner. This petition is for Probate of last Will and Testament of deceased filed by petitioners namely Arthur Anthony Rangel and Philomena Frances Rangel, both being surviving Executors named under the Will of deceased. The deceased namely Rolden Rangel said to have died at Mumbai on 12.07.1989. Copy of death certificate is annexed to the petition. Ld. Advocate filed an Affidavit for dispensing the Affidavit dated 09.12.2024. The same is accepted.

2. The deceased left behind his last Will and Testament which was duly executed at Mumbai on 11.07.1989. The said Will is in English language. The Para No. 2 of the Will refers to the appointment of three Executor. The two executors are petitioners herein and the third executor viz. Virgin Rangel died on 23.03.1995.

3. Ld. Advocate for petitioner submits that parents of the deceased predeceased the deceased. Daughter viz. Bella died on 16.07.2024 and she was survived by husband and two daughters. Therefore, deceased was survived by one son, one son-in-law and two grand-daughters. Out of them son is petitioner herein and all have given their consent in favour of the petitioner. Consent Affidavit is on record. There are no other legal heirs.

4. Petitioner's oath is filed. Affidavit of Patrick Crasto dated 18.12.2024 one of the Attesting Witness to the Will is filed. Affidavit of Service of General Citation dated 08.04.2025 is filed. All other legal formalities are complied with. Hence, petition is granted.

5. Office to issue Probate as prayed after verifying whether any cross petition is filed or whether any caveat is filed. COMPANY REGISTRAR / TESTAMENTARY REGISTRAR 23.06.2025
